Last updated: 5 November 2026

Nexus Performance ("Nexus", "we", "us" or "our") runs strength and performance gyms in Burleigh Heads (Gold Coast), Townsville and Melbourne, plus online coaching and nutrition services. This policy explains what personal information we collect, why we collect it, how we look after it, and how you can access or correct it.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. What we collect

Depending on how you deal with us, we may collect:

  • Contact and identity details: name, email, mobile number, date of birth, address and emergency contact.
  • Enquiry details: what you tell us when you fill in a form on our website or a lead form on Facebook or Instagram, such as your goals and training experience.
  • Membership and payment details: membership type, sign-up and billing records, and gym attendance and door-access records. Card and bank details are handled by our payment providers. We don't store full card numbers.
  • Training and coaching information: your goals, training history, lifting numbers, programs, check-in answers, and progress photos or videos you send us.
  • Health information: injuries, medical conditions, medications, pre-exercise screening, body measurements, nutrition information and, if you choose to share them for coaching, blood test results.
  • Call records: consult and coaching calls may be recorded and transcribed so your coach has accurate notes. We'll let you know when a call is being recorded.
  • Website and advertising data: cookies, IP address, device and browser details, and the pages you visit (see section 4).
  • Photos and video: taken in our gyms, at competitions and at events.

Health information

Health information is "sensitive information" under the Privacy Act. We only collect it with your consent, and only when it's reasonably needed to train you safely or deliver the service you've signed up for.

How we collect it

Mostly directly from you: when you fill in a form, sign up, book a call, message or email us, or talk to us in person. We also receive your details from Meta when you submit a lead form on Facebook or Instagram, and through the apps and software we use to deliver our services.

2. How we use your information

We use your personal information to:

  • respond to your enquiry and contact you about our services
  • set up and manage your membership, account and payments
  • deliver coaching, programming and nutrition services, and track your progress
  • keep you safe while you train
  • run competitions, seminars and events
  • send you updates, offers and news (you can opt out at any time)
  • advertise our services, including showing ads to people who have visited our website
  • improve our services and website
  • meet our legal obligations

Marketing

We may send you emails or SMS about our services, offers and events. Every marketing message includes a way to unsubscribe, or you can email us. We don't sell your personal information.

Photos, video and testimonials

We sometimes film or photograph training sessions, competitions and events for our social media and marketing. We'll ask your permission before we feature you or use your results or testimonial. If you'd rather not be filmed, just let a staff member know.

3. Who we share it with

We only share your information when we need to, with:

  • Our team: the coaches and staff who need it to look after you.
  • Service providers who help us run the business, such as our gym management and access software, coaching app, website and email platform, payment and direct debit providers, cloud storage and office tools, scheduling and call transcription tools, SMS providers and automation tools.
  • Advertising platforms such as Meta (Facebook and Instagram), to run and measure our ads.
  • Competition organisers and federations, when you register for a competition through us.
  • Others where required or allowed by law, such as government agencies, or emergency services if your safety is at risk.

Storage outside Australia

Some of our service providers store data overseas, including in the United States. When we use providers outside Australia, we take reasonable steps to make sure they protect your information.

4. Cookies, the Meta Pixel and analytics

Our website uses cookies and similar tools, including the Meta Pixel and analytics tools, to understand how people use our site, measure our ads, and show our ads to people who have visited us. These tools collect information such as your IP address, device and browser, and the pages you view.

You can block or delete cookies in your browser settings, and manage how Meta uses your information for ads in your Facebook or Instagram ad preferences. Some parts of our site may not work properly if cookies are blocked.

5. Under 18s

For our Youth Program and any member under 18, we collect personal information with the consent of a parent or guardian.

6. Keeping your information safe

We take reasonable steps to protect your information from misuse, loss and unauthorised access. Access is limited to people who need it. We keep information only for as long as we need it for the purposes above or as the law requires, then delete or de-identify it.

7. Accessing or correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it, by emailing us (see below). We'll respond within a reasonable time, usually within 30 days. If we can't give you access, we'll explain why.

8. Complaints

If you think we've mishandled your personal information, please contact us first so we can try to fix it. We'll respond within 30 days. If you're not happy with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
